Terms of Service

1. Interpretation and Definitions

1.1 Interpretation

Words with capitalized initial letters have meanings defined under the following conditions. These definitions shall have the same meaning whether they appear in singular or plural.

1.2 Definitions

For the purposes of these Terms of Service:

  • Account means a unique account created for You to access our Service.
  • Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote.
  • Application refers to the software provided by the Operator, available for download on any electronic device, named VISIT POREČ.
  • Buyer refers to users who place Orders for Goods through the Service.
  • Company ("We," "Us," or "Our") refers to VISIT POREČ, CEN TOURS D.O.O., TRG SLOBODE 2A, 52440 POREČ, OIB 40135.
  • Content means text, images, or other information posted, uploaded, linked, or otherwise made available on the Service.
  • Device means any device that can access the Service, including computers, mobile phones, or tablets.
  • Feedback means suggestions, comments, or ideas submitted by You regarding our Service.
  • Goods refers to items or services offered for sale, rental, auction, contact, or any other form of trade via the Service.
  • Operator refers to VISIT POREČ / STEVO ŽUFIĆ.
  • Order means a request by You to purchase or trade Goods via the Application or Website.
  • Seller refers to users listing Goods for trade by any means.
  • Service refers to the Application, Website, or both.
  • Terms of Service ("Terms") refer to this agreement governing the use of the Service.
  • Third-party Social Media Service refers to any third-party services or content displayed through the Service.
  • Website refers to VISIT POREČ, accessible at https://visitporec.eu.
  • You refers to the individual or entity accessing or using the Service.

These Terms of Service govern your use of the Service and form a legal agreement between You and the Company or Operator. By accessing or using the Service, You agree to abide by these Terms. If You disagree, do not use the Service.

You confirm that You meet the legal age requirements of your country or Croatia, whichever is higher. Those under this age are prohibited from using the Service.

4. Governing Law and Legal Compliance

4.1 Governing Law

These Terms shall be governed by the laws of Croatia, excluding conflict of law principles.

4.2 EU Consumer Rights

If You are an EU consumer, You benefit from any mandatory provisions of the law of your country of residence.

4.3 U.S. Compliance

You warrant that You are not in a country subject to U.S. embargoes or designated as a "terrorist-supporting" country and are not listed on any U.S. government restricted lists.

4.4 Severability

If any provision is found unenforceable, it will be modified to the closest possible meaning under the law, while the remaining provisions remain in effect.

4.5 Waiver

Failure to enforce any provision shall not constitute a waiver of rights.

5. User Accounts

5.1 Account Creation

To create an account, You must provide accurate and complete information. Failure to do so may result in immediate termination.

5.2 Account Information

You may be required to provide identification, payment, and personal information to complete transactions.

5.3 Security

You are responsible for safeguarding your password and notifying Us of any unauthorized use.

5.4 Account Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms.

6. Content Guidelines

6.1 User-Generated Content

You are solely responsible for the Content You post. You grant Us a non-exclusive license to use and distribute such Content.

6.2 Prohibited Content

You may not post unlawful, offensive, misleading, or harmful Content. We reserve the right to remove such Content and suspend associated accounts.

6.3 Intellectual Property & Copyright

We respect copyright laws. If You believe copyrighted material is used unlawfully, please contact Us.

7. Orders & Transactions

7.1 Service as an Intermediary

We act as a facilitator between Buyers and Sellers and are not responsible for disputes.

7.2 Order Process

Orders require valid payment information and compliance with applicable terms.

7.3 Cancellations & Refunds

  • Orders canceled by Buyers may not be refunded.
  • Sellers canceling Orders may be required to refund Buyers.
  • Contact Us for disputes.

8. Limitation of Liability

To the fullest extent permitted by law, We disclaim all warranties and liabilities related to the Service. Our liability shall not exceed 100 € or the amount paid by You through the Service.

8.1 - Additional Terms Regarding User Responsibility and Communication

Service providers (vendors) independently submit and manage the content of their listings. They are solely responsible for the accuracy, relevance, and timeliness of all provided information, including descriptions, pricing, availability, and communication with users. Visit Poreč is not liable for any listing content entered by providers.

All users (vendors and buyers) are required to communicate in good faith using the available messaging tools with the aim of reaching a mutual agreement. Visit Poreč may, but is not obligated to, intervene or mediate in case of disputes.

Users acknowledge that Visit Poreč does not guarantee the number of inquiries, bookings, or success of any listing, nor the outcome of business interactions initiated through the platform.

8.2 - Consumer protection and portal’s right to perform checks and take action

To ensure consumer protection and maintain trust in the Visit Poreč platform, the Operator reserves the right to inspect any listing, user profile, or business activity of a provider at any time.

If the Operator determines, at its sole discretion, that a provider is not adhering to the published terms of their listing, is operating contrary to applicable regulations, market standards, good business practices, or fairness towards consumers, the Operator may, without prior notice:

temporarily or permanently remove the listing,

block the visibility of the offer,

suspend or permanently terminate the provider’s account,

notify competent authorities or the public, if deemed appropriate.

The Operator holds full discretionary authority to decide on the necessity and scope of any action and is not required to justify its decisions to the provider. All actions are taken in the interest of consumer protection and the integrity of the platform.

9. Dispute Resolution

We encourage informal resolution of disputes. If unresolved, disputes shall be settled in Croatian courts.

10. Intellectual Property

The Service and its original content remain Our exclusive property.

11. Changes to These Terms

We may update these Terms at any time. Continued use after revisions means You accept the updated Terms.
